About these terms
These terms govern access to the Applied Velocity website and, where no separate written agreement applies, the Applied Velocity platform. By accessing or using either, you agree to these terms.
If your organisation has signed an order form, services agreement, data-processing agreement or other written contract with us, that agreement takes priority to the extent of any conflict. If you use Applied Velocity on behalf of an organisation, you confirm that you have authority to bind it.
Accounts and access
You must provide accurate information, keep credentials confidential and promptly tell us if you suspect unauthorised access. You are responsible for activity carried out through your account unless caused by our breach of these terms.
Access may be limited by workspace role, organisation instructions, plan or agreement. You may not share access outside the authorised organisation or attempt to bypass permissions, security controls or usage limits.
Acceptable use
You must not use Applied Velocity to:
- break the law, infringe rights or facilitate harmful or deceptive activity;
- upload data you are not authorised to use;
- harass, discriminate against or unlawfully monitor people;
- introduce malware or probe, disrupt or overload the service;
- reverse engineer the platform except where that restriction is prohibited by law;
- resell or provide access unless we have agreed this in writing; or
- use outputs as the sole basis for legally significant employment decisions.
We may investigate suspected misuse and restrict access where reasonably necessary to protect people, customers, the platform or our legal obligations.
Your data and interview responsibilities
You and your organisation retain rights in data submitted to the service. You grant us the rights needed to host, process, transmit and generate requested outputs from that data for the purpose of providing and protecting Applied Velocity.
Your organisation is responsible for deciding who should be interviewed, providing appropriate notices, establishing a lawful basis, configuring access, and using findings fairly. Do not submit special-category, highly sensitive or regulated data unless this is expressly covered by your agreement and appropriate safeguards are in place.
Our handling of personal data is described in the privacy policyand, where applicable, a customer data-processing agreement.
AI-assisted features and outputs
Applied Velocity uses AI to conduct interviews, organise information and create analysis or drafts. Outputs may be incomplete, inaccurate, non-unique or unsuitable for a particular decision. They do not constitute legal, financial, employment or other professional advice.
You are responsible for reviewing outputs, checking important facts and applying appropriate human judgement. You must not present a generated inference as a verified statement from a participant unless the underlying evidence supports it.
Intellectual property
Applied Velocity and its licensors own the platform, website, software, design, documentation, methodology and related intellectual property, excluding customer data and third-party material. We grant authorised users a limited, revocable, non-transferable right to use the service during the applicable access period.
Feedback may be used to improve our products and services without restriction or payment, provided we do not publicly identify you without permission.
Third-party services and availability
The platform may rely on or connect to third-party infrastructure, AI models, links and integrations. Their availability and terms may affect features. We are not responsible for third-party services that you connect or access outside Applied Velocity.
We aim to provide a reliable service but do not promise uninterrupted or error-free operation unless a separate service level is agreed. We may change, maintain or retire features and will use reasonable efforts to avoid material disruption.
Suspension and termination
We may suspend or restrict access where reasonably necessary to address a security risk, unlawful use, material breach, non-payment under an applicable agreement, or a legal requirement. Where practical, we will give notice and an opportunity to resolve the issue.
Access ends when the applicable agreement, invitation or account ends. Data export and deletion are handled under the relevant agreement and our retention obligations. Provisions intended to survive termination, including ownership, liability and dispute terms, will continue.
Disclaimers and liability
Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud or fraudulent misrepresentation, or death or personal injury caused by negligence.
To the extent permitted by law, Applied Velocity is not liable under these website terms for indirect or consequential loss, loss of profit, revenue, goodwill or anticipated savings, or for decisions made without appropriate review of AI-assisted outputs. Liability for paid services is governed by the applicable written agreement.
Public website content is provided for general information and may change. You should obtain appropriate advice before relying on it for a significant decision.
Changes, law and contact
We may update these terms to reflect changes to the service, law or risk. The current version and update date will be published here. Material changes affecting existing customers will be communicated as required by the applicable agreement or law.
If a provision is unenforceable, the remaining provisions continue. A delay in enforcing a right is not a waiver. You may not transfer these terms without our consent; we may transfer them as part of a reorganisation, financing or sale of the relevant business.
